In addition to the sheer ignorance spoken by Chief Justice Roberts (see quote), the ruling invokes public opinion as further justification that national security wins over environmental impact.
Not included in the is article is another quote by Roberts. “Even irreparable injury to the mammals is outweighed by the public interest in effective, realistic training of the sailors,” he said. “The fact that the Bush Administration has taken years and still has not completed the federal Environmental Impact Assessment is irrelevant since the president, by executive order, has determined that the training is essential to national security.”
There is great precedence that public opinion and the general well-being of the citizenry are to be considered in the deliberations by the Supreme Court. My contention is that the general public has no clue how pressing a need it is that the Navy use sonar. In this case, public opinion is ill-informed and cannot be cited as further justification of the use of sonar.
To top it off, an Environmental Impact Study (EIS) hasn't even been conducted! So without any evidence that the sonar is fucking with the whales navigation abilities, the court has DEFERRED to the opinions and judgment of military officials and the commander-in-chief. It's maddening how one-sided this ruling is!
Quoted: In his decision, Roberts wrote that the Navy had been using sonar off of the California coast for 40 years with "without a single documented sonar-related injury to any marine mammal," and that "The president -- the commander-in-chief -- has determined that the training with active sonar is 'essential to national security.' [...] We give great deference to the professional judgment of military authorities."
